5 Safety Tips for Children Walking to School

by Staff Blogger | August 3rd, 2016

It’s hard to believe that summer is almost over for our children. Soon they’ll head back to school for another year. Many Nashville students live close enough to their schools to be able to walk to and from every day. Although convenient for the student and the family, walking to school can be dangerous, especially in our busier metropolitan areas. Before school starts, discuss the following pedestrian safety tips with your child:

  1. Always cross at a crosswalk. Most pedestrian accidents occur while crossing the road. Whenever possible, your child should cross at a crosswalk, and even then, they should look both ways first. Just because they have a walk signal doesn’t mean drivers see them or will stop.
  2. Be alert. Many pedestrian accidents could have been avoided if the pedestrians had been constantly aware of their surroundings. That means no cell phones until they’ve reached their destination.
  3. Wear proper clothing. Depending on what time your children leave for school or head home, it could be dark. Invest in a reflective vest or make sure your child wears light-colored clothing so they stand out in the dim light.
  4. Travel in groups when possible. From a pedestrian’s standpoint, there really is safety in numbers. When possible, have your child walk with 2 or more others. A group will stand out to drivers and can look out for each other’s safety.
  5. When in doubt, call. If your child ever feels unsafe walking home, they should have someone they can call to pick them up or arrange other transport. Have a backup plan ready for days when walking isn’t an option.

At Ponce Law, we defend the rights of injured pedestrians in Nashville, but we look forward to a day when there is no one to defend. Speak with your child today about pedestrian safety, and let’s make this school year accident-free.

What is a Wrongful Death Lawsuit?

by Staff Blogger | August 1st, 2016

The loss of a loved one is always traumatic, no matter the circumstances. However, when that death is sudden and could have been avoided, it leaves you with questions along with your grief. Who’s responsible? What could have been done to prevent it from happening? How can you get justice for your loved one? As the surviving family member, you deserve answers to these questions, and that’s exactly what we work toward for our clients in your situation.

A wrongful death lawsuit gives surviving family the ability to hold those responsible for your loved one’s death accountable for the damages their actions have caused, not only to your loved one but to your family going forward. If it weren’t for their fatal actions, your loved one would have potentially lived a long, fruitful life. Now that they’re gone, the full potential of their life has been lost. Although a monetary recovery on your loved one’s behalf won’t bring him or her back, it will help secure your family’s financial future in his/her absence.

If you’ve lost a loved one due to someone else’s negligence, call our experienced Nashville wrongful death attorneys today for a free consultation. We’ll approach your case with the respect and dignity your loved one’s memory deserves, and we won’t stop until we’ve secured you justice.

The Realities of a Personal Injury Case

by Staff Blogger | July 25th, 2016

There are a number of realities one must accept in a personal injury case, the most important of which is that, when handled correctly, they take time. At Ponce Law, our goal is to get you the largest amount of money for your claim in the least amount of time. However, it’s important to understand that those two things are not mutually exclusive. In fact, time corresponds directly to the amount a claim is worth and here’s why.

Your case is predicated on the fact that you’ve been injured, and because of your injuries, you are entitled to compensation. The extent of that compensation depends on the amount of medical treatment your injuries require. Determining how much medical treatment you require takes time, which is why we never rush into a settlement agreement. If we did, some of your upcoming expenses might be left out of the demand, leaving you with the bill.

Believe us when we say that we know the personal injury process can seem long. Just know that we’re doing everything within our power to maximize your claim in a timely matter, just as we’ve done for all of our clients over the years. Check out some of their stories here.

And if you’ve been injured and have yet to secure legal counsel, give our Nashville personal injury lawyers a call today for a free consultation.

There’s lots of construction going on it Nashville. From new condos to improved roads and highways, our city is growing so fast that construction companies are busy trying to keep up. With that increased construction comes more jobs, which is a good thing. It also means more workplace accidents. When a construction worker is injured on the job, their employer should provide them the financial support they need to pay medical expenses and lost wages, but unfortunately that doesn’t always happen, leaving him/her with two options: 1) work injured or 2) pursue legal action.

A workers’ comp attorney knows your rights and will do everything within their power to get you maximum compensation for your injuries.

If you’ve been injured on the job, we know you have questions. Who’s going to pay your medical bills? How will you make ends meet if you can’t work? The Realities of Applying for Social Security Disability

by Staff Blogger | July 20th, 2016

There are a number of realities when it comes to applying for Social Security Disability (SSD) benefits. First of all, your chances of securing benefits aren’t great on your own. In fact, two-thirds of initial applicants are denied benefits. That’s tens of thousands of people every single year. Secondly, the application process can be long and arduous, especially if you’re trying to do it all on your own. Thirdly, just because you are disabled, doesn’t automatically mean you qualify for disability benefits. The SSA’s definition of disability is extremely strict, which is one reason there are so many denials.

The good news is those who appeal with the help of a lawyer are more likely to secure benefits. It just makes sense. An experienced Social Security Disability lawyer has potentially handled hundreds of SSD cases. They know what works, what doesn’t, and quite frankly, how to win benefits. Sure, you can find plenty of resources online that tell you how to file an appeal, but why not consult with an attorney that can go beyond the how to and give you the best chance of securing benefits, potentially for life?

If you’ve been denied Social Security Disability benefits, give us a call today for a free consultation. We’ve helped disabled folks in your same situation secure the benefits they deserve, and we’re ready to help with your appeal as well. Don’t put years’ worth of disability benefits at risk by going it alone. Contact our Nashville Social Security Disability lawyers today.

I-40 Among the Deadliest Highways

by Staff Blogger | July 18th, 2016

Traffic in Nashville is getting worse. With the mass influx of new residents and visitors pouring into the city, our roads are more congested and more dangerous than ever. In fact, Nashville has one of the deadliest interstates in the country—one you may drive on every single day. According to a recent study published by the Auto Insurance Center, I-40 is the third deadliest highway in the U.S., accounting for more than 180 deaths last year.

In addition, Tennessee ranked high for unbuckled drivers and passengers. That’s a scary statistic considering 45% of all people killed in traffic accidents neglected to buckle up. Other major factors of motor vehicle deaths included driving under the influence (31% of fatalities) and speeding (28% of fatalities). These statistics aren’t meant to frighten you off the roads. They’re meant to inform you of the dangers involved in the most fundamental and necessary daily task: getting from A to B. Our hope is that drivers will take these dangers to heart, drive safer, and change these statistics for the better.

Unfortunately, you can only control the way you drive, and sometimes no matter how safe you are, you’re still involved in an accident. If you’ve been injured in a car accident, give us a call for a free, no obligation consultation. Our experienced Nashville car accident attorneys will defend your rights and fight to get you maximum compensation for your injuries. Don’t become part of the growing statistic of accident victims who didn’t get what they deserve. Call us today.

The Rules of the Road

by Staff Blogger | July 15th, 2016

There are rules to the road. They apply to everyone, no matter how much money you make, where you live, or how many years you’ve been driving. These rules are put in place to protect Nashvillians depart and arrive safely to their destinations every time. When a careless driver breaks one of those rules, they needlessly put everyone around them at risk.

At Ponce Law, we handle several different types of auto accident cases, almost all of which could have been avoided if the at-fault driver had simply obeyed the rules. Whether running a stop sign or driving drunk, that at-fault driver, and their insurance company are liable for the damage they’ve done and must be held accountable. In a perfect world, the insurance company would do the right thing from the start, but unfortunately, in our experience, that rarely happens. So accident victims turn to us, and we fight to make the insurance company live up to their responsibility.

If you’ve been injured in a car accident, standing up for yourself and demanding fair compensation is more than the right decision for your family. It’s the right thing to do for your community as well. We believe that every time we secure maximum compensation for a client, we make our roads a little safer and send a clear message to the insurance company that there’s a Nashville law firm they can’t push around. Give us a call today for a free, no obligation consultation.
