DOT Puts the Brakes on Tennessee Trucking Company for Federal Violations

trucl_accident_overturnTennessee trucking company, Three Angels Farms, has been shut down by the U.S. DOT’s Federal Motor Carrier Safety Administration, after an extensive review uncovered numerous federal violations concerning driver qualification requirements, hours-of-service compliance, vehicle maintenance and even drug and alcohol testing. Trucking accidents account for a significant number of serious injuries and tragic loss of life in Tennessee and across the United States every year, due in large part to the failure of trucking companies to adhere to federally-mandated safety regulations in favor of making a profit. If you have suffered injuries caused by a trucking accident in Tennessee, contact our qualified trucking accident lawyers at Michael D. Ponce & Associates today.

TN Truck Company Poses Hazard to Public Safety

Federal officials ordered Three Angels Farms and its owners to immediately terminate all transportation services, based on critical safety violations that posed an imminent hazard to public safety. During the review of the trucking company, investigators found that the company failed to conduct proper drug and alcohol testing of its drivers and also allowed drivers to operate commercial trucks without a proper commercial driver’s license. The Federal Motor Carrier Safety Administration oversees the trucking industry, establishing safety precautions meant to protect the safety of drivers and other motorists on Tennessee roadways. Unfortunately, when truck drivers or trucking company owners fail to observe these regulations, the consequences can be devastating.

Three Angels Farms Shows “Continuing and Flagrant Disregard” for Federal Regulations

During the past six months, Three Angels Farms trucks have been involved in two trucking accidents involving fatigued or disqualified drivers and poorly maintained vehicles. Following the second accident, the Tennessee FMCSA Division Office conducted a compliance review of the trucking company, revealing widespread regulatory violations that “demonstrate a continuing and flagrant disregard for compliance with the FMCSRs.” Not only are the three drivers employed by Three Angels Farms not qualified to operate a commercial vehicle, but the company has also continued to operate commercial vehicles in interstate commerce without adhering to pre-employment drug testing regulations; without an adequate vehicle maintenance program; without adhering to hours of service, log, and records of duty status requirements; and with insufficient oversight of its drivers and their qualifications.
