Emergency responders in Tennessee face dangerous and traumatic situations while serving and protecting our communities. This can leave lasting emotional impacts, including PTSD, anxiety, and depression. Unfortunately, getting workers’ compensation for these mental health conditions has been difficult because responders have struggled to prove that they developed these conditions as a result of the stress and trauma of their jobs. To address this, the Tennessee Legislature passed the James “Dustin” Samples Act, named after a firefighter who sadly took his own life after struggling with PTSD and losing access to care. The James “Dustin” Samples Act allows a PTSD diagnosis to be presumed as work-related if it is diagnosed within a year of leaving the job and linked to certain traumatic experiences on the job, such as witnessing death or serious injury. This law makes it easier for first responders to get the care and compensation they deserve.
